Cancellation & Refund, Penalty

We are dedicated to ensuring your stay with us is comfortable and enjoyable. Please be advised that we operate under a strict No Refund Policy for the following reasons:

  • 1. Reservation Commitment: When you make a reservation with our Resort, you are reserving specific dates and room(s). These commitments often result in turning away potential guests. As a result, we are unable to offer refunds for cancellations or no-shows.
  • 2. Operational Considerations: To maintain operational efficiency and uphold our commitment to quality service, we plan and allocate resources based on confirmed reservations. Last-minute cancellations can disrupt this process, making it challenging for us to manage our operations effectively.
  • 3. Fair Treatment for All Guests: To ensure fairness to all our guests, we apply our No Refund Policy consistently. This approach helps us maintain a level playing field for everyone and allows us to provide the best possible service to all our patrons.
  • 4. Peak Season Cancellation: No refund of deposit can be given for December and January Due to the Peak Season rush and room demand/availability.
  • 5. Short Notice Cancellation:No refund of deposit for cancellations made less than 10 days Before date of arrival.
  • 6. Refund subject to conditions: For all months other than December & January – 70% of Deposit will be refunded for cancellations made 3 months before the date of arrival. 60% refund of deposit will be made for cancellations made 2 months before the date of arrival. 50% refund will be made for cancellation made 15 days before the date of arrival.
  • 7. Special Circumstances: In the event of unforeseen circumstances or emergencies, we encourage you to contact our reservations team. While our general policy is a strict no-refund, we may evaluate situations on a case-by-case basis and consider providing a credit for future stays.
  • 8. Amendments:Amendments to your reservations may be possible if requested 2 months in advance. Requests made less than 2 months in advance are subject to availability.
  • 9. Other Deposits: Deposits for arranging local tour packages, adventurous sports activities, local transportation, Scooty – motor bike – car rentals, meet & assist etc. will not be refunded against cancellation received on or before 10 days of activity.
  • 10. Refund:Upon receipt of a cancellation request in compliance with our above terms & conditions, the same will be forwarded to our Accounts department for necessary verification and reverted to you within 7 working days. Refunds will be made after deducting the necessary bank charges.
Penalty

By hiring a room in our Resort you are allowed to use the property and facilities, limited to the allocations/permissions, gently and very properly without any nuisance, hindrance or damage to other guests/visitors/employees/property and vehicles parked at the parking lot. In case of any damage occurred due to the negligence or deliberate action of the guest, cost of damage in full or part thereof subject to the extent of damage, will be levied from the guest by Resort.

Jurisdiction

Any disputes or claims arising out of, relating to, or in connection with the dealings of Blue Water Beach Resort shall be governed by and construed in accordance with the laws of the jurisdiction of Varkala, Trivandrum District. Any such disputes or claims shall be subject to the exclusive jurisdiction of the courts of Varkala, Trivandrum District, without regard to any principles of conflicts of law.
